ANSWER SHEETS (RTI)

APIC JUDGMENTS ON ANSWER SHEETS


The unflinching efforts of a couple of individuals have meant that the Answer sheets should now be provided to an applicant to scrutinize and verify his/ her answer scripts and to satisfy themselves that marks have been awarded to them “objectively & judiciously”.

The Hon’ble SCIC of the APIC had decreed that the answer sheets of the PG exams be provided to Dr. L. Srinivas. In his judgment he made the following observation…

“The Hon’ble High Court of Delhi while dealing with an appeal in a similar matter, challenging the order of the Central Information Commission directing to provide a certified copy of the answer sheet to a student, held that the answer sheet cannot be excluded from the purview of Right to Information Act and the examination authority cannot deny the same to students under the Act and directed the Institute of Charted Accountants of India to provide a certified copy of the paper to students under the RTI Act. The Hon’ble High Court of Delhi further observed that the RTI Act legitimately confers positive power to citizens and there should be no further delay in such matters. In view of the above, the Vice Chancellor, Dr. NTR University of Health Sciences is directed to provide copies of the answer scripts of Papers I, II and III to Dr. L. Srinivas, DPM Post Graduate, IMH, Osmania Medical College…”

In fact, the Hon’ble SCIC of the APIC while disposing off an appeal filed by Mr. Y. Naresh had also decreed that the answer sheets of the exams conducted by the APPSC also be provided to the applicant. The judgment can be accessed on the following link…
