Appeal to the First Appellate Authority

Sir,


Sub :- Appeal (1st) against the refusal of the Public Information Officer, APPSC to furnish the requested information - Reg.

Ref:- Copies of the Request Application and the Challan (No.82403) dated 08-12-2008 - Enclosed.


Sir, it is with a deep sense of disappointment that I bring to your notice the following facts:

On 08-12- 2008, I had submitted an application with the Public Information Officer, APPSC requesting for information on the recruitments made to the Group-1 Services under the Notification No. 21/ 2003 and the Supplemental Notification No. 6/ 2004. In the same application, I had also requested for information on Group- II recruitments made under Notification No. 10 /2004.

Sir, I haven’t received any communication from the APPSC, till date in gross violation of the provisions of the RTI Act, 2005 which clearly state that under sub-section 8 of Section 7 of the Act, even if a request for information is rejected;


(i) the reasons for such rejection;

(ii) the period within which an appeal against such rejection may be preferred; and

(iii) the particulars of the appellate authority should be provided to the Applicant.

Sir, the fact that I haven’t received any communication whatsoever even after 40 (forty) days, speaks volumes about their ignorance or may be something more sinister.

Sir, I humbly request you to take cognizance of this and pass such orders to see that I am provided with the information sought. Sir, I also request you to impose on the authorities concerned, such penalties as are applicable U/s. 20 of the RTI Act 2005, for the delay in providing the information.

P.S Under Section 20 of the RTI Act 2005, only the State Information Commission or the Central Information Commission, as the case may be, is authorized to impose penalties.
